Terms of Service

1. Agreement

By creating an account or using TheSurePlug, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the services.

We may update these Terms periodically. Continued use after changes become effective constitutes acceptance of the updated Terms. The “Last updated” date appears at the top of this page.

2. Accounts

• You must provide accurate information and keep it up to date.
• You are responsible for activity under your account and for safeguarding credentials.
• Phone-based authentication and passwords may be used depending on the product flow.
• One person should not share an account in a way that compromises security or fraud controls.
• You must meet the minimum legal age in your jurisdiction to form a binding contract and use the services.

3. Marketplace roles

TheSurePlug operates a platform with multiple roles:

• Customers browse merchants, place orders, pay, and receive deliveries.
• Merchants list products/services, accept and fulfil orders, and may set or agree delivery arrangements depending on category.
• Drivers / delivery partners accept and complete delivery jobs according to platform rules and applicable law.

Merchants are independent businesses. Unless expressly stated, TheSurePlug is not the seller of merchant goods. Drivers are independent contractors or partners as defined by their onboarding agreement, not employees of TheSurePlug, unless a written agreement says otherwise.

Certain roles require identity (KYC) or business (KYB) verification before full access is granted.

4. Orders and delivery

• Order acceptance, preparation times, and item availability are controlled by merchants.
• Delivery ETAs are estimates and may change due to traffic, weather, distance, or demand.
• You are responsible for providing a correct delivery address and being available to receive the order.
• Restricted, illegal, or unsafe items may not be ordered. We may cancel orders that violate law or these Terms.
• Issues with order quality, missing items, or delivery should be reported promptly via in-app support or support@thesureplug.com.

5. Payments and wallet

• Prices are shown in the applicable market currency before you confirm checkout.
• Payments may be made using supported methods such as card (via Paystack or other processors) or TheSurePlug wallet balance.
• Fees, taxes, and delivery charges (where applicable) are disclosed at checkout.
• Wallet top-ups and charges create ledger entries. Unauthorized use of payment methods is prohibited.
• Refunds are handled according to the circumstances of the order, merchant policy, and applicable law. Approved refunds may return to wallet or original payment method depending on the case.

6. Acceptable use

You agree not to:

• Violate any law or third-party rights
• Harass, threaten, or discriminate against other users, merchants, or drivers
• Attempt to defraud the platform, manipulate prices, or abuse promotions/referrals
• Reverse engineer, scrape, or overload our systems without permission
• Upload malware or unauthorized content
• Impersonate others or misrepresent affiliation with TheSurePlug

7. Content and intellectual property

TheSurePlug branding, software, and site content are owned by us or our licensors. Merchants retain rights to their menus and product content but grant us a license to host and display that content to operate the marketplace. Feedback you send may be used to improve the product without obligation to you.

8. Disclaimers

The services are provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, error-free operation, or that every merchant listing is accurate. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, TheSurePlug and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our aggregate liability arising out of these Terms or the services will not exceed the greater of (a) the amounts you paid to us for the specific order giving rise to the claim in the three months preceding the claim, or (b) USD 50 (or local currency equivalent), except where liability cannot be limited by law (including death or personal injury caused by negligence, or fraud).

10. Suspension and termination

We may suspend or terminate access if you breach these Terms, create risk for other users, or if required by law. You may stop using the services at any time and may request account deletion via thesureplug.com/delete-account.

11. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law principles, unless mandatory consumer protections in your place of residence require otherwise. Courts in Lagos, Nigeria shall have jurisdiction, subject to applicable consumer venue rights.
